1. About these terms
These terms govern your use of MyBiography, a service that creates personal biography books from recorded interviews. The service is operated by MyBiography BV, registered in the Netherlands at Laan van Vlaanderen 141B5, 1066 MP Amsterdam ("MyBiography", "we", "us"). You can reach us at support@mybiographybook.com.
By purchasing or using MyBiography, you agree to these terms. Please read them alongside our Privacy Policy, which explains how we handle personal information. If you do not agree with these terms, please do not use the service.
2. The two roles: buyer and subject
MyBiography involves up to two people:
- The buyer — the person who purchases a biography and holds an account. The buyer enters into this contract with us.
- The subject — the person whose life story is recorded. The subject may be the buyer (someone capturing their own story) or a different person (for example, a parent whose biography is commissioned by their child).
These terms form a contract between us and the buyer. Where the subject is a different person, the buyer confirms they are entitled to commission a biography of that person, and the subject takes part on the basis of their own consent, explained before the interview begins.
3. Who can use MyBiography
MyBiography is for adults. Both the buyer and the subject must be at least 18 years old, or older if the age of majority in their country is higher. By purchasing, the buyer confirms that they and the subject (where different) meet this requirement.
4. What you are buying
You are buying the creation and delivery of a personal biography, in the format and package you choose at purchase. Each package includes the full biography; packages differ in format, materials, and the number of photographs included, as described at the point of sale. The process — interview, personalisation, and delivery of the finished book — is described on our website before you buy.
The biography is created using artificial intelligence from what the subject shares in the interview. Your interviewer isn't a person — it's artificial intelligence: the questions are asked by an AI system and read aloud in a synthetic voice, and the written biography is generated from the interview by AI tools.
5. How the biography is created, and what to expect
The biography reflects what the subject chooses to share. It is a personal keepsake based on the subject's own account of their life — not a verified or independent historical record. It may contain inaccuracies, gaps, or details remembered differently from how others recall them, and it reflects the subject's perspective.
Before the book is produced, the buyer approves it for print at the personalisation stage. At this stage the buyer chooses the writing style (using short sample passages provided for that purpose), finalises the photographs, and selects the format and number of copies. The buyer approves the book for print on the basis of these choices; the full text of the biography is not shown before printing. By approving the book for print, the buyer confirms they are satisfied with the choices available to them at that stage.
We take care to render faithfully what the subject shares, but we do not guarantee that the biography is factually complete or error-free, because it is built from personal memory and spoken recollection.
6. The interview and what each person can see
The interview is conducted with the subject, and the subject decides what to share. Where the buyer and the subject are different people, the buyer holds the interview link as well: the buyer can open the interview, see the exchange on screen, and continue it — many subjects ask the person who arranged the book to sit with them and help with the device. The buyer cannot play back the recordings of the subject's answers, and no draft of the biography is shown to anyone before the book is produced.
At the personalisation stage, the buyer finalises the book: the buyer can review, add, and remove the photographs added during the interview, and chooses the writing style and other options for their package. The subject is told, before the interview begins, what the buyer will and will not be able to see.
7. Ownership and permissions
Your story is yours. The underlying facts and memories of the subject's life belong to the subject. We make no claim of ownership over anyone's life story.
The book is yours to keep. Once delivered, the finished biography is yours to keep, read, and enjoy. More precisely, the buyer and subject receive a personal, non-commercial right to keep, read, print, and privately share the finished biography with family and friends. We keep this framing simple deliberately, because the book is created with the help of AI from the subject's memories, edited through our platform, and may include photographs belonging to different people.
Permission to create your book. By providing interview answers, photographs, names, and other materials, the buyer and/or subject grant MyBiography a limited licence to use that material only to provide the service: to conduct the interview, create the biography, produce and deliver the book, process the order, and support corrections or reorders. We do not use it for any other purpose.
What you do not receive. The personal right to the finished book does not include the raw materials we use to produce it — the interview recordings, the written transcript, or intermediate drafts. These are working materials, held and deleted according to our Privacy Policy, and are not part of the delivered product. (Separately, the subject may exercise their data-protection rights over their own personal data, including the right to access their interview data, as described in the Privacy Policy — this is a privacy right and is independent of these ownership terms.)
Our platform is ours. The MyBiography service — our software, designs, templates, interview system, and brand — remains our property. Nothing in these terms transfers any of it to you.
8. Personal use, not commercial use
The finished biography is for personal, non-commercial use. The buyer and subject may keep it, share it privately with family and friends, and order further copies through us at any time.
Nothing in these terms stops the subject from telling, writing, publishing, or commercialising their own life story independently — their story is theirs to do with as they wish. What is restricted is the MyBiography book itself — our generated text, layout, design, and other platform-created materials — which may not be sold, licensed, or commercially distributed without our written agreement.
9. Payment
Prices are shown at the point of sale and include the items listed for your package. Payment is processed by our payment provider, Stripe; we do not store your full card details. Additional copies, format upgrades, and extra photographs beyond your package's included allowance may be added at the personalisation stage or as later reorders, at the prices shown.
10. Your right to cancel, and refunds
Before purchase, please note an important point about cancellation rights. Under EU consumer law, you normally have 14 days to withdraw from an online purchase. However, this right does not apply to goods that are made to your specifications or clearly personalised, nor to digital content you have agreed we may begin producing immediately. A biography created from your interview is, by its nature, made to order and personalised.
In practical terms, this is how cancellation and refunds work:
- Before the biography is written. If you change your mind at any time before the biography is written — including while the interview is still in progress, or if the subject does not complete it — you can cancel and receive a full refund, no reason required. Just contact us at support@mybiographybook.com.
- Once the biography has been written or sent to print. At this point the personalised product has been made, and an automatic right to a refund no longer applies. We may still offer a refund or other resolution at our discretion (see below).
If something is wrong with your book. If the finished book has a printing defect, a production error, a delivery problem, or a clear mistake caused by our service, please contact us. Our standard remedy is to correct the book and send you a new copy at no charge — we would much rather make your book right than simply refund it. Changes requested after approval that are not caused by an error in our service (for example, a change of mind about wording, or a memory the subject would now tell differently) may be handled as paid edits or reorders. Where we are genuinely unable to put right a fault that is our responsibility, you remain entitled to the remedies the law provides for faulty goods, which may include a refund.
If a subject withdraws their consent. A subject can withdraw at any time, and we will stop processing and delete the information we still hold (see the Privacy Policy). If the subject withdraws before the biography is written, the buyer receives a full refund. If the subject withdraws after the biography has been written, approved, printed, or delivered, we stop further processing and delete the data we still hold, but we cannot recall physical copies already delivered; any refund or replacement then depends on the stage reached and applicable law.
All refunds, where given, are made through the original payment method.
11. Delivery
For physical packages, the finished book is printed and shipped to the address provided by the buyer. Estimated delivery times are shown at purchase and are estimates, not guarantees; printing and delivery are carried out by our print partner. For digital packages, the finished biography is delivered as a file to the buyer's account and email. Risk of loss for physical goods passes on delivery; if a book arrives damaged or does not arrive, contact us and we will put it right.
12. Your responsibilities
You agree to provide accurate information, and to share only content — including photographs — that you have the right to use and are comfortable including. A biography may mention other people; please share only what you are comfortable including about them.
You must not upload or provide content that is unlawful, defamatory, invasive of another person's privacy, sexually explicit without consent, abusive, or that infringes someone else's rights. You agree not to misuse the service, attempt to disrupt it, or use it for any unlawful purpose. We may refuse, suspend, or cancel an order where we reasonably believe the service is being misused or would expose us or others to legal risk.
13. Our responsibility to you
We provide the service with reasonable care and skill. To the extent permitted by law, we are not liable for losses that are not a foreseeable result of our breach, for the accuracy of personal recollections shared in the interview, or for delays caused by our print or delivery partners beyond our reasonable control. Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or your rights as a consumer under Dutch and EU law.
14. Accounts
The buyer's account is created automatically when an order is placed. You are responsible for keeping your login secure. You can request closure of your account at any time by contacting us; closing your account leads to deletion of the associated information as described in the Privacy Policy.
15. Changes to the service and these terms
We may improve or change the service over time. We may update these terms as the product evolves; when we make a material change, we will update the date above and, where appropriate, notify account holders. Changes do not apply retroactively to an order already placed.
16. Governing law
These terms are governed by the laws of the Netherlands, and disputes fall under the jurisdiction of the competent Dutch courts. As a consumer, you also keep the protection of any mandatory rules of the country where you live, and these terms do not take away your statutory consumer rights.
